USCIS Has Reached Fiscal Year H-1B Cap as of 4/7/2016

The USCIS announced today that it has received more H-1B employer petitions than the 65,000 available under the fiscal year cap.  It has also received more than the available 20,000 U.S. Masters degree H-1B requests.  A lottery will be held, though no specifics on the timing were provided by USCIS. 

 The USCIS previously announced that they would suspend premium processing on these Fiscal Year 2017 cap cases until mid-May. 

All cases not selected for the lottery will be returned, including fees. 

WSM expects that employers will hear whether their petitions were accepted beginning in May.
