H-1B Initial Electronic Registration Selection Process Completed

On March 30, the USCIS announced that between March 9 and March 25, 2021, it had received enough electronic registrations for the FY 2022 H-1B cap to complete the selection process. The USCIS confirmed that it has notified all prospective employers of its selections via their online myUSCIS account. 

Each employer’s online account will now show one of the following statuses for each beneficiary registered:

  • Submitted: A registration status may continue to show “Submitted” after the initial selection process has been completed. “Submitted” registrations will remain in consideration for selection until at least the end of the fiscal year (September 30, 2021).
  • Selected: Selected to file a FY 2022 H-1B cap-subject petition.
  • Denied: Multiple registrations were submitted by the same registrant for the same beneficiary.
  • Invalidated-Failed Payment: A registration was submitted, but the payment method was declined, not reconciled, or otherwise invalid.

Only employers whose registrations were selected may file H-1B cap-subject petitions for FY 2022, and only for the selected beneficiary in the registration notice. Selected registrants will have at least 90 days from selection in which to finalize and file those petitions. We anticipate that over the next six months additional H-1B numbers will become available, so there is still a possibility of selection. We note that for last year’s process, it took until February 2021 for USCIS to send all official “non-selection” notices.
