USCIS Further Expands Premium Processing for Certain Already Filed I-140s

Today the USCIS announced that it is moving to the third phase of premium processing expansion, applied only to previously filed I-140 petitions under the EB-1C multinational executive and manager classification and the EB-2 classification for national interest waivers. The second phase was announced on 7/15/2022.
Beginning 9/15/2022, the USCIS will accept Form I-907 requests for premium processing for-
- EB-1C multinational executives and manager I-140s filed on or before 1/1/2022 (previously 7/1/2021); and
- EB-2 national interest waiver I-140s filed on or before 2/1/2022 (previously 8/1/2021).
The USCIS states that they will take action on these requests within 45 days. They will not accept new (initial) I-140s for these categories with a premium processing request at this time.
The USCIS previously announced the expansion of premium processing to additional case types. Under its phased in approach, the USCIS plans to expand premium processing to Forms I-539 and I-765 as well, at a later date. The USCIS is taking a phased in approach to the expansion of premium processing to ensure no adverse impact on processing time for other immigration benefits.
